Digital Monopoly Creation Act (DMCA)
Posted by Dana Blankenhorn

It was designed as the Digital Millenium Copyright Act, but while Congress debates making the law more draconian against innovation, the fact is that judges are systematically destroying the competitive American economy under the DMCA's current provisions.
How else do you explain this -- a legal decision forbidding third-party service on disk drives based on the DMCA?
StorageTek now has an absolute, 100%, legal monopoly on servicing its disk units, and under the logic of this decision, so does anyone else who puts software code inside a device.
This is monstrous. Unsought relief, and total monopolies on service, created through the misapplication of a flawed law that lawmakers want to make even more draconian.
Why does Orrin Hatch hate America?
